Terms of service
In effect from 8 September 2026.
These terms cover use of the AIMcom console and interface by a venue that has subscribed. If you are a customer who spoke to an automated assistant, these are not your terms: the privacy policy is the page you want, and your agreement is with the venue you contacted.
1. The agreement
The service is provided by Quipu Software Solutions ("Aimatric") to the organisation that subscribed ("you"). Where a signed order form or master agreement exists, it prevails over these terms wherever the two differ.
2. What the service does
AIMcom answers your customers on WhatsApp, takes and changes bookings, sends confirmations and reminders, and writes bookings into the system you already run. What it can do depends on what you have configured and on which connectors are in place.
Your system stays the system of record for your business. AIMcom integrates with it and does not replace it. If the platform is unavailable, you continue to operate from your own system.
3. What it is not for
- Marketing or promotional messaging. Service and transactional communication only. This is a hard boundary, not a setting, and it is how the platform stays within Indian telemarketing rules.
- Taking payment. Card details are never handled. Send customers to your own payment page.
- Advice. The assistant refuses allergen, dietary, medical and legal questions and hands them to a person, every time, including where your knowledge base contains the answer. See section 6.
4. Your responsibilities
- You decide what is collected and why. You are the Data Fiduciary or controller; Aimatric processes on your instructions. Your own privacy notice must cover your use of this service.
- Consent is yours to obtain. A WhatsApp message you start requires the customer's prior agreement. The platform records the evidence and refuses to send without it, but obtaining it is yours.
- Keep your configuration true. Opening hours, capacity, policies and knowledge are answered to customers as fact. Wrong configuration produces wrong answers.
- Accounts belong to people, not to shifts. Give each person their own account with the least role that lets them do their job, and remove it when they leave.
- Respect an opt out. The platform enforces it across every channel. Do not work around it by other means.
5. Availability
We aim for 99.9% availability of the conversational path during business hours and 99.5% monthly for the console, measured across all venues. Maintenance is scheduled outside business hours in both markets, which in practice is a narrow window because India and Malaysia are two and a half hours apart.
Where a service credit regime applies it is in your order form. These figures are targets and are not themselves a warranty.
6. The safety refusal
The assistant refuses every allergen, dietary safety, medical and legal question and hands it to a person. It does this even where your knowledge base plainly contains the answer, and the behaviour cannot be configured off.
This is deliberate. An incorrect allergen answer produced by a language model is a foreseeable route to serious harm, and no commercial term would make that acceptable. If your operation needs allergen questions answered, they must reach a person who can answer them.
7. Automated conversation
Every conversation opens by disclosing that the customer is speaking with an automated assistant, and a route to a person is available at any point. You may configure the wording; you may not remove the disclosure or the route to a person.
The assistant states only what it can trace to your configuration or to a result from your system. It is nonetheless software, and you remain responsible for what your venue commits to. Check the interaction record if a customer disputes what was agreed; it is kept for that purpose.
8. Fees
As set out in your order form. Usage beyond an included allowance is charged as stated there. Every charge is traceable to the individual interactions and messages that produced it, and that derivation is available to you.
9. Your data
Your data remains yours. We process it to provide the service and for no other purpose. We do not use your customers' conversations to train a general purpose model.
On termination you may export your bookings, customers and interactions in a machine readable form. After a wind down period agreed in your order form, your data is deleted.
10. Suspension
We may suspend an account that is being used for marketing or cold calling, that is sending messages people have not agreed to receive, or that puts the platform's messaging quality rating at risk for other venues. Where the matter is not urgent we will raise it with you first.
11. Liability
Neither party excludes liability that cannot lawfully be excluded. Subject to that, and except where your order form says otherwise, neither party is liable for indirect or consequential loss, and each party's total liability is limited to the fees paid in the twelve months before the claim.
12. Governing law
The laws of India, courts at Hubballi, Karnataka
13. Changes
We may update these terms. Material changes are notified in advance to the contact on your account.
